Description Reviews the remedies available in private law. The perspective adopted will be that of the remedial goals, namely compensation, restitution, punishment and coercion. The unit cuts across the traditional compartments of tort, contract and property on the one hand, and law and equity on the other, placing students in a position to critically evaluate the remedial rules in light of the goals which private law seeks to achieve when redressing or preventing legal wrongs.
Contact time Seminars: 3 hours per week.
Prerequisites Enrolment in Common Law (BCL) and successful completion of BCL250 Australian Common Law System, or successful completion of L120/LEG120/LAW120 Research and Writing; L150/LEG150/LAW150 Australian Legal System; L152/LAW152 Torts; L130/LAW130 Criminal law and Procedure; L260/LAW260 Contract; successful completion of, or concurrent enrolment in, L253/LAW253 Property and L351/LAW351 Equity and Trusts.
